DMCA Policy

Last Updated: June 4, 2026

Our Commitment: Werners Store respects the intellectual property rights of others and expects our users to do the same. We are committed to responding to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act of 1998 ("DMCA"), the text of which can be found at the U.S. Copyright Office website at www.copyright.gov.

1. What is the DMCA?

The Digital Millennium Copyright Act (DMCA) is a United States copyright law that was enacted in 1998. It criminalizes the production and dissemination of technology, devices, or services intended to circumvent measures that control access to copyrighted works. The DMCA also provides a framework for copyright holders to request the removal of infringing content from websites and online services.

The DMCA's "safe harbor" provisions (Section 512) protect online service providers from liability for copyright infringement by their users, provided the service provider follows certain procedures when notified of infringement. Werners Store complies with these procedures as outlined in this policy.

2. How This Applies to Werners Store

As an affiliate website, the content displayed on Werners Store primarily consists of:

  • Product Images: Sourced from Amazon and stored locally, displayed under the terms of the Amazon Associates Program. These images are the property of the respective product manufacturers, sellers, or Amazon.
  • Product Descriptions: Sourced from Amazon product listings and attributed to the respective sellers and manufacturers.
  • Original Content: Website design, layout, original text, and curation created by Werners Store.

If you believe that any content on our website infringes upon your copyright, you may submit a DMCA takedown notice as described below. We take all copyright claims seriously and will respond promptly to legitimate notices.

3. Filing a DMCA Takedown Notice

If you are a copyright owner (or authorized to act on behalf of one) and believe that content on our website infringes your copyright, you may submit a written DMCA takedown notice. To be effective, your notice must include ALL of the following elements as required by 17 U.S.C. Section 512(c)(3):

  1. Identification of the Copyrighted Work: A clear identification of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, you may provide a representative list of such works. Be as specific as possible — include the title, registration number (if applicable), and a description or link to the original work.
  2. Identification of the Infringing Material: Identification of the material that you claim is infringing and that you want removed or access to which you want disabled. You must provide information reasonably sufficient for us to locate the material on our website. This should include the specific URL(s) where the infringing content appears.
  3. Your Contact Information: Your full legal name, mailing address, telephone number, and email address so that we can contact you regarding your notice.
  4. Good Faith Statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law. This statement should be written in your own words and reflect your genuine belief.
  5. Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Physical or Electronic Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf. An electronic signature can be a typed full legal name.

4. How We Process DMCA Notices

Upon receiving a valid DMCA takedown notice that complies with all requirements outlined above, we will take the following actions:

4.1 Review and Verification

We will review the notice to ensure it contains all required elements. If the notice is incomplete, we may contact you to request additional information. Incomplete notices may not be acted upon until all required information is provided.

4.2 Content Removal

If the notice is valid and complete, we will promptly remove or disable access to the allegedly infringing material. We aim to process valid notices within 48-72 hours of receipt, though complex cases may require additional time.

4.3 Notification

If applicable, we will make a reasonable attempt to notify the party responsible for the content that it has been removed or disabled. This notification will include a copy of the takedown notice (with personal contact information redacted if appropriate).

4.4 Record Keeping

We maintain records of all DMCA notices received and actions taken in response. These records are kept for a minimum of three years for legal compliance purposes.

5. Counter-Notification Process

If you believe that material removed from our website as a result of a DMCA takedown notice was removed erroneously or was misidentified, you may file a counter-notification. A valid counter-notification must include:

  • Identification: Identification of the material that was removed and the location where it appeared before removal.
  • Statement Under Penalty of Perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Werners Store may be found), and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.
  • Your Contact Information: Your full legal name, mailing address, telephone number, and email address.
  • Your Signature: Your physical or electronic signature.

Upon receiving a valid counter-notification, we will:

  1. Forward the counter-notification to the original complainant.
  2. Inform the original complainant that the removed material may be restored in 10-14 business days.
  3. Restore the material within 10-14 business days unless the original complainant files a court action seeking to restrain the alleged infringer from engaging in the infringing activity.

6. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Werners Store has adopted a policy of terminating, in appropriate circumstances, the accounts or access of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our website and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

7. Important Warnings About Filing DMCA Notices

Before filing a DMCA takedown notice, please consider the following carefully:

  • Perjury Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability for damages, including costs and attorneys' fees.
  • Fair Use Consideration: Before filing a notice, please consider whether the use of your copyrighted material may constitute "fair use" under 17 U.S.C. Section 107. Fair use allows limited use of copyrighted material without permission for purposes such as criticism, commentary, news reporting, teaching, scholarship, or research.
  • Authorization: Ensure that you are the copyright owner or are legally authorized to act on behalf of the copyright owner before filing a notice.
  • Amazon Content: If your concern relates to product images or descriptions that are sourced from Amazon, you may also wish to contact Amazon directly, as they are the primary host of such content.

8. Designated DMCA Agent

All DMCA notices and counter-notifications should be sent to our designated DMCA agent:

  • Contact Method: Through our Contact Page with the subject line "DMCA Notice" or "DMCA Counter-Notification"
  • Response Time: We aim to acknowledge receipt of all DMCA communications within 48 hours.

9. Good Faith Efforts

Werners Store makes good faith efforts to ensure that all content displayed on our website is either:

  • Original content created by us.
  • Content used with proper authorization (such as through the Amazon Associates Program).
  • Content that falls within fair use or other legal exceptions.
  • Content in the public domain.

If you believe we have inadvertently used your copyrighted material without authorization, we encourage you to contact us before filing a formal DMCA notice. In many cases, we can resolve the issue quickly and amicably through direct communication.
